INTRODUCTION

CHEK HEALTH LTD. and our affiliates and subsidiaries ("Chek", "we", “us” or “our”) makes certain health related information available to you and facilitates your access to various services, including providing assistance for routine cancer screening and follow up (the “Services”).

When facilitating your access to the Services, Chek collects, uses and discloses your personal and health information. We respect your privacy and are committed to protecting it by complying with this privacy policy (the “Privacy Policy” or “Policy”).

This Policy describes the kinds of personal and health information we collect, use and disclose about you, why we collect it, how we use it, how we protect it and under what circumstances we share it with third parties. This Policy applies when you (“you” or the “user”) visit our website at chekhealth.ca (the “Website”), download, register with, access or use the Chek app (the “App”), or when you use any of our Services (collectively, the “Sites”). Please take the time to review this Policy and understand it. If you do not agree with our policies and practices, do not download, register with, or use our Sites. By accessing, downloading, registering with, or using the Sites, you signify your acceptance of our Privacy Policy and indicate that you understand, accept and consent to our collection, use, retention and disclosure of your personal and health information in accordance with this Privacy Policy and as permitted by law.

In Alberta, the health care provider has overall responsibility for your personal health information and is the “custodian” as defined in the Alberta Health Information Act. This Policy does not apply to the collection, use, retention and protection of your personal health information by such health care providers through the Sites, which is part of the health provider’s records. The Sites are a tool used by your health care providers that does not alter their obligations or responsibilities for information they collect.

This Policy does not apply to information that you provide or is collected by any third party, including, among other things, any links to third-party websites, advertisements, plug-ins, services or applications that may link to or be accessible from the Sites. These third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.

Your continued use of the Sites after we make changes indicates that you accept and consent to those changes, so please check the Policy periodically for updates. When using the App, at the time of initial sign up, you will provide express consent for the use, collection and disclosure of your Personal Information and to receipt of email notification and reminders and such consent will be required prior to proceeding with the collection and use of Personal Information.

Chek applies security safeguards appropriate to the sensitivity of the information, such as encryption, retaining information in secure facilities and making Personal Information accessible only to authorized employees on a need-to-know basis.

Personal information you share with us is stored on our database servers at our data centers or hosted by third parties who have entered into agreements with us that require them to observe our Privacy Policy.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Sites. CHILDREN UNDER THE AGE OF 13

Our Sites are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Sites. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. We may charge you a fee to access your Personal Information, however, we will notify you of any fee in advance.

We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the Personal Information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the Personal Information that we hold about you, or we may have destroyed, erased, or made your Personal Information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
